United Kingdom government promises to 'respect Gibraltar's interests' in Brexit negotiations

Their lawyer, George Peretz QC, argued the Government could not choose to leave the single market on its own, but would need the authorisation of Parliament - and also to give a withdrawal notice.

However, the Scottish Government says it believes that because of the direct effects on the devolved responsibilities, the Scottish Parliament should be invited to give its view before the bill is passed.

The campaigners who lost their case were led by Peter Wilding, chairman of the pro-EU pressure group British Influence, and Leave-voting Conservative lobbyist Adrian Yalland.

"The referendum was on membership of the EU, not the EEA, nor of [the European Court of Human Rights]", Yalland said, adding that "it was not an opinion poll on immigration".

But the judges refused to give the green light for the challenge, saying they would give their reasons later.

The UK Parliament must vote to authorise triggering Article 50, the British Supreme Court ruled on Tuesday (24 January), in a landmark verdict and a blow to Theresa May's government.

In January May effectively left no doubt as to her government's intentions.

Last month, May pledged to take the United Kingdom out of the EU's single market, saying there is no option that leaves Britain "half-in, half-out". The claimants argued it could not do so without parliamentary approval, much in the same way as Article 50 cannot be triggered without the same.

As it pertains to UK Overseas Territories, the paper says, "As the UK leaves the European Union, the unique relationships that the Crown Dependencies of the Isle of Man and the Channel Islands and the Overseas Territories have with the European Union will also change".

Making his statement on the White Paper in the House of Commons, Brexit Secretary David Davis said there would be a transitional phase before the official split from the EU. However, government lawyers told judges that when Britain leaves the European Union, the EAA would automatically cease to exist.
