Trump's order has also resulted in several lawsuits filed on behalf of current and future USA military soldiers. A few days after Trump sent him a directive on the issue, Mattis announced on August 29 that he would "carry out the president's policy direction" while "in the interim, current policy with respect to now serving members will remain in place".

"Once the panel reports its recommendations and following my consultation with the secretary of Homeland Security, I will provide my advice to the president concerning implementation of his policy direction", Mattis said in the statement.

It continued, "Mattis did not reverse Trump or defy him on the broader ban against new recruits who are transgender people".

Dating back to last summer, when the Obama administration announced that transgender people could openly serve in the military, the executive branch has made a distinction between those who are already in the service and those who want to enlist. That's one reason it benefits the military to keep transgender individuals who have gone through full military training and are already serving in the US Armed Forces.

"Though Defense Secretary Mattis appears rightly troubled by the president's action, his statements do not change the directive nor has he been given the power to retain transgender service members indefinitely", Strangio said. The implementation plan will "promote military readiness, lethality, and unit cohesion, with due regard for budgetary constraints and consistent with applicable law". In section 1 (b), the President requests that both Mattis and the Department of Homeland Security complete a thorough study to determine whether "terminating that policy [allowing trans folk to serve in the military] and practice would not have the negative effects", which some have pointed out may follow from removing people from active duty. Coast Guard Commandant Paul Zukunft seemingly defied his Commander-in-Chief by saying he would "not break faith" with "transgender" members serving in the Coast Guard.

Trump's announced that he would reinstate the ban before providing guidance to the Pentagon.

On hearing Mattis' implementation directive, social conservative leaders signaled immediately that any effort by the DoD brass to water down or jettison Trump's policy barring "transgender" service will be met with fierce opposition. Mattis postponed that deadline in June, and Trump tweeted about his plans in late July.

Mattis' move buys time for the Pentagon to determine how and if it will allow thousands of transgender troops to continue to serve, whether they will receive medical treatment, or how they will be discharged. ACLU attorney Chase Strangio pointed out that Mattis can only offer recommendations to the Trump administration and that he would be unable to shield transgender troops from being dismissed.
