Kenya's presidential re-run may be postponed

In the aftermath of the annulled poll, opposition officials repeatedly described the election results as a fraud and claimed that Odinga, who leads the National Super Alliance (NASA), was the "legitimate" victor.

The Supreme Court nullified the result, citing irregularities, after Odinga filed a petition claiming the electoral commission's computers were hacked to generate a victory for Kenyatta.

Lawyers for the National Super Alliance (NASA) coalition of opposition parties, led by Raila Odinga, last month challenged the re-election of President Uhuru Kenyatta, alleging rigging, hacking and tampering with results.

Doubts are growing over Kenya's ability to hold a rerun of its presidential election in just one month as key players remain unable to agree on how to conduct a credible vote.

Meanwhile, the electronic voting system due to be used in a re-run of Kenya's presidential poll will not be ready in time, the French biometrics firm behind it said Monday.

The court's majority decision to annul the poll - the result of which was announced three weeks ago - surprised many observers and embarrassed local, African and western observers who said they had found no major problems with the election.

The system was designed that way after a disputed 2007 presidential vote sparked violence that killed around 1,200 people and displaced some 600,000 more. Chief Justice David Maraga mentioned only "irregularities and illegalities", notably in the transmission of election results.

Mwilu said the IEBC refused a court order demanding it open its computer servers.

"Noncompliance or failure by the board to do as ordered must be held against it", she said.

Kenyatta promised to respect the ruling although he has repeatedly criticised it harshly.

About 10,000 paper forms from polling stations, each containing the documentation of anywhere from dozens to hundreds of votes, were missing when the results were announced.

While admitting that "no election is ideal", the judges in the majority said that IEBC had disregarded electoral laws and behaved as if they "did not exist".

It comes as riot police fired tear gas at supporters of Kenyatta amid protests outside the Supreme Court.

Human Rights Watch urged the police to heed the chief justice's call and increase protection for the judiciary.
