Mobile phone-Aadhaar link: Supreme Court issues notice to Centre

The Supreme Court said that by that logic, the Centre too can challenge the rules framed by the state government, and asked Mamata Banerjee to file the petition in individual capacity.

As per the media reports the Supreme Court of India (SCI) has today rejected the petition filed by West Bengal government against the Centre's move to make Aadhaar mandatory for availing the benefits of various social welfare schemes.

"How can a State challenge a law made by the Parliament?".

The Union government will now have to submit its reply within four weeks. She said she is not going to link her phone with Aadhaar, let them disconnect it.

The Centre had, on October 25, told the top court that the deadline for mandatory Aadhaar linking to avail benefits of various government schemes has been extended till March 31 next year.

The bench asked senior counsel Kapil Sibal appearing for the State government "How can a state file such a plea".

However, Venugopal had told the bench that he would take instructions on certain issues on Aadhaar after which the court had asked him to mention the matter again on October 30.

The validity of Aadhaar law that has been challenged by a number of people, including former Karnataka High Court Judge K.S. Puttaswamy, first Chairperson of National Commission for Protection of Child Rights and Magsaysay awardee Shanta Sinha and researcher Kalyani Sen Menon.

The Centre hinted that those who have Aadhaar will have to link with government welfare schemes by December 2017. However, the final hearing in the main Aadhaar matter, is pending before the apex court. Article 32 can not be agitated by a State against the Centre, a technicality that the state government's counsel, senior advocate Kapil Sibal, seems to have overlooked while moving the apex court which in turn led the top court to rap Banerjee's government. Meanwhile, the court issued notice to the Centre on a separate plea filed by an individual challenging the linking of mobile phone numbers with Aadhaar.
