Three-judge panel: No victor declared in House of Delegates' 94th district

The entire scape of the Virginia state legislature was changed Tuesday after a recount finalized a Democrat's victory in a seat formerly held by a Republican with a margin of just one vote. Democrat Tom Michie edged Republican Joe Wright by one vote. Anderson said the judges took the filled in bubble for Yancey, which was not crossed out, as intent to vote for the GOP House candidate.

The victor of the tie will be determined "by lot" according to state law, AP reported, meaning Republicans would maintain power by one seat, 51-49 if Yancey is declared the victor. Her win gives the chamber a 50-50 split between the parties instead of the 51-49 advantage the GOP would have had if Yancey had held on. "And we won it by one vote".

A battle over one vote has left control of the Virginia House of Delegates up in the air - and headed for the winner's name to be drawn at random.

Yancey challenged the ballot, which was not counted during the recount, after the election official wrote a letter Tuesday night saying it should have been counted for Yancey. Democrats are still waiting for a decision in their lawsuit seeking a new election in the Stafford-area 28th District, which was won by Republican Bob Thomas by 82 votes.

The official wrote that although he signed off on the ballot, which was not counted a day earlier, he was confused at the time.

"We're now 50-50", Democratic Governor Terry McAuliffe told the Associated Press. "I believe one locality uses an old-fashioned tri-corner hat for these occasions", Alcorn told the paper.
