Adler blasts ICE director's threat to jail local elected officials

California's law officially making it a sanctuary state went into effect Monday, but acting Immigration and Customs Enforcement Director Thomas Homan said that's not going to deter his agency from protecting residents in The Golden State.

"We've got to take the sanctuary cities on, we've got to take them to court, and we've got to start charging some of these politicians with crimes". (Many do not honor ICE requests to "hold" arrested people in jails without charges while immigration checks can be performed.) Despite the fact that there's no demonstrable connection between sanctuary policies and increased crime, sanctuary cities have been a favorite Trump talking point since his Presidential campaign.

The statute, in part, states that a person is in violation of the law if he or she is "knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to hide, harbor, or shield from detection, such alien in any place, including any building or any means of transportation".

"There's no sanctuary from federal law enforcement", he said. U.S. courts have repeatedly held feds can't force states/localities to do Trump's bidding on draconian deportation tactics.

At least two fake signs welcoming "felons, illegals and MS13" to California's "sanctuary state" were removed from freeways near the border with Nevada and Arizona, according to news reports.

Homan also said politicians are dead wrong if they think the new law will deter federal immigration officers. That's an alien-smuggling statute.

Sanctuary jurisdictions-cities, counties, and, now in California's case, even entire states-are places where law-enforcement agencies minimize their coöperation with federal immigration enforcement.

"For these sanctuary cities that knowingly shield and harbor an illegal alien in their jail and don't allow us access, that is, in my opinion, a violation of 8-USC-1324. So California just bit off a lot more than it can chew", he said.

ICE is out there doing things that, one day, are going to embarrass the conscience as much as the revelations about torture did.

Cecillia Wang, the ACLU's deputy legal director, echoed these sentiments and said in a statement that there is "no valid basis to prosecute any state or local official under federal criminal law for carrying out a sanctuary policy".

So, when can local law enforcement still talk to ICE?
