Mississippi's New Abortion Law Is The Most Restrictive In The Nation

Within six hours, the governor signed a bill banning most abortions after 15 weeks of gestation, the state's lone abortion clinic sued, and a federal judge set a Tuesday morning hearing to consider blocking the restrictions.

Bryant signed the law Monday and it took effect immediately.

The only abortion clinic in the state quickly filed a complaint in federal court to block the law.

"The Supreme Court says every woman has a constitutional right to "personal privacy" regarding her body", Reeves wrote in a brief decision that quoted previous legal rulings on abortion. The governor said the law "protects maternal health and will further our efforts to make MS the safest place in America for an unborn child".

The lawsuit challenges House Bill 1510, saying federal courts have ruled women have the right to an abortion before a fetus can live on its own outside the womb.

Republican Gov. Phil Bryant made the comments while he signed the law Monday in a closed ceremony, according to a video his office posted to social media.

Cincinnati.com pointed out that the bill is unlikely to pass. OH governor John Kasich previously vetoed a bill that would have banned abortions after a fetus's heartbeat could be detected, which could be as early as six weeks.

These abortion bans have been unconstitutional since Roe v. Wade legalized abortion in 1973, and they will remain unconstitutional unless the U.S. Supreme Court either overturns its landmark decision or reverses 40 years' worth of case law about the importance of fetal viability.

The Institute has been particularly critical of efforts underway in the United States by various state authorities to undermine access to abortion services which, it claims put 57 percent of child-bearing age American women in states hostile or extremely hostile to abortion rights, compared to 30 percent living in states which are highly supportive.

"I was proud to sign House Bill 1510 this afternoon", Bryant said on Twitter.

Three clinics in Louisiana perform abortions and the process to access the procedure has been heavily regulated by state lawmakers.

MS already bans abortion at 20 weeks and has long had some of the most restrictive anti-abortion laws in the country.

In papers filed earlier Monday evening, the Jackson Women's Health Organization and a physician who practices there stated that a woman who is 15 weeks or more pregnant is scheduled to have an abortion Tuesday afternoon.

A federal judge in MS will hear arguments Tuesday over whether he should block the nation's most restrictive abortion law less than 24 hours after it took effect.

"We believe this law should be a model for the rest of the country", Jameson Taylor, acting president of the Mississippi Center for Public Policy, said in a statement.

The Center for Reproductive Rights maintains that the law violates "longstanding Supreme Court precedent". Bryant has frequently said he wants MS to be the "safest place in America for an unborn child". Courts have consistently struck down similar bans on abortion before viability as unconstitutional. There are no exceptions for incidents of rape or incest.
