Oregon Man to Sue Gun Store

The suit says Dick's action amounts to age discrimination.

Field and Stream store is owned and operated by Dick's Sporting Goods, which announced February 28 they were restricting the sale of guns to anyone younger than 21 years of age and ending the sale of assault-style firearms.

Dick's changed its policies because "thoughts and prayers are not enough", Chief Executive Edward Stack said in a statement, referencing a phrase often used after mass shootings that has become increasingly mocked. But others say there's room for a challenge.

A 20-year-old OR man on Monday filed lawsuits against Walmart and Dick's Sporting Goods for refusing to sell him a firearm, just a week after both retailers announced they would not sell guns to anyone under the age of 21.

The plaintiff, Tyler Watson, claims he faced "Unlawful Age Discrimination".

Watson's suit alleges that Dick's policy violates OR law against age-based discrimination for people 18 years and older in places of public accommodations. It was not immediately clear whether Watson learned about the change before he went to the Walmart store.

"Saying you may discriminate on the basis of age for anyone under 21, now you've discriminated against a person's Second Amendment right", he said.

The Dick's Sporting Goods employee, Griffin Mccullar, posted a photo of a printed resignation letter on his Facebook page dated February 28, the same day the company's chief executive officer, Edward Stack, announced the decision on ABC's "Good Morning America". A company spokeswoman said the retailer is unsure what it will do with the inventory but has "committed that the guns will not be made available in any marketplace in any way". provides commenting to allow for constructive discussion on the stories we cover. Federal law prohibits the sale of handguns to minors, but not rifles or shotguns.

Adam Winkler, a professor at the UCLA School of Law, agreed. After a number of outlets bowed to public pressure and announced that they wouldn't sell rifles to anyone under the age of 21, a lawsuit was pretty much inevitable. According to The Oregonian, Oregon law allows people to own shotguns and rifles from the age of 18.

Dick's previously raised the sales age to 21 in the wake of last month's school shooting in Parkland, Fla.
