Susan Collins Won't Support Anti-Roe v. Wade Nominee

On Sunday, Leonard Leo, an outside adviser to Trump on judicial nominations, said he expected Trump to select a nominee who is mindful of precedent but who is also more "originalist and textualist".

The president told reporters Friday that his choice will likely be made from a previously released list of 25 potential nominees.

Since each Supreme Court justice needs 51 votes to be confirmed, Democrats would only need one Republican to side against the nominee, assuming no Democrats break rank.

"I think the person who is chosen will be outstanding", he added.

Justice Anthony Kennedy announced last week that he was retiring at the end of of July, triggering fears that his GOP-appointed replacement would lead the court in overruling the historic Roe v. Wade decision legalizing abortion.

Manchin, Donnelly and Heitkamp voted to confirm Gorsuch, making them a sharper target of Republicans ahead of the midterms.

"A nominee's position on whether or not they respect precedent will tell me a lot about whether or not they would overturn Roe v. Wade", she told ABC News' Martha Raddatz during an interview Sunday.

In March 2017, Collins endorsed Trump's first Supreme Court nominee, Neil Gorsuch, who replaced the late Justice Antonin Scalia.

CBS News says it has learned that DC Circuit Court Judge Brett Kavanaugh and Chicago Circuit Court Judge Amy Coney Barrett are now Trump's leading contenders for the appointment to the nation's highest court.

"That will happen, and that'll happen automatically, in my opinion, because I am putting pro-life [anti-abortion] justices on the court", Trump said at a presidential debate against Democratic candidate Hillary Clinton. Collins said she would only back a judge who would show respect for settled law such as the Roe decision, which has always been anathema to conservatives.

Trump has explicitly vowed in the past to appoint justices who would overturn Roe v. Wade, the landmark case that affirmed abortion as a constitutional right, and his nominee following Kennedy's retirement will determine the majority of the high court for decades to come.

Trump has said he is focusing on up to seven potential candidates, including two women, to fill the vacancy being left by Kennedy, a swing vote on the nine-member court.

"The bottom line: Judge Barrett has given every indication that she will be an activist judge on the court", Schumer said. So far, Murkowski has stayed relatively mum on the topic, saying only that she would "carefully scrutinize the qualifications of judicial nominees" and would cast an "independent vote".

Sanders also announced that her deputy Raj Shah will take leave from his role to "oversee communications, strategy and messaging coordination with Capitol Hill allies" surrounding the Supreme Court nomination. I will say this: "It will go back to the states, and the states will then make a determination". "You're voting on whether that nominee is going to change precedent", said Cantwell.
